Terms of Service
These Terms are the agreement between you and GroovaClass for using groovaclass.com. By creating an account or using GroovaClass, you agree to them. Our Privacy Policy and Cancellation & Refund Policy are part of these Terms.
GroovaClass is based in Boston, Massachusetts. Questions: support@groovaclass.com.
1. Joining GroovaClass
- GroovaClass is invitation-only. You join with an invitation code. A personal code works once; a campaign code can be used by a set number of people until it expires.
- You must be at least 18, or have the consent of a parent or guardian. Children under 13 cannot have an account.
- One account per person. Keep your details accurate and your password to yourself; you are responsible for what happens under your account.
- We may remove access that was obtained with a code that was sold, stolen or otherwise misused.
2. Account types
Each account has one type, chosen when you join. To change it, write to support.
- Learner: watch Classes, add credit, book workshops, unlock tutorial clips, save favourites and review workshops you attended.
- Instructor (choreographer): publish Classes and tutorial clips, book studio time, run workshops, and get paid through Stripe Connect.
- Studio: list your spaces, open time slots with an hourly price, and earn a flat fee for each workshop held there.
3. GroovaClass credit
Workshops and tutorial clips are priced in US dollars and paid from your GroovaClass credit (earlier called ClassPoints). One dollar of credit is worth one dollar.
- Adding credit: by card, through Stripe. Stripe's card processing fee is added at checkout and shown before you pay, so the credit you receive is the amount you chose.
- Credit you buy does not expire. If your account has no activity for one year (no booking, tutorial unlock or credit purchase), we refund the unspent credit you bought to the card it came from, most recent purchase first. We remind you one month, one week and one day before. If a card cannot take the refund, the credit stays on your account and we contact you.
- Credit you are given, such as an invitation bonus, a campaign or promotional credit, or a credit from our team, expires 90 days after you receive it. It is never paid out to a card.
- When you pay, the credit you received earliest is used first.
- Credit can be used only on GroovaClass. It cannot be transferred to another person or exchanged for cash, except for the refunds to your card described in these Terms.
- Stripe's card processing fee is not refunded when credit goes back to a card.
4. Workshops
- An instructor creates a workshop in a studio's time slot and sets one price per person, the capacity and the minimum number of bookings it needs to run. The minimum is set so that the bookings cover the studio's fee.
- You book by paying the price from your credit. Places go first come, first served, up to the capacity.
- If a workshop has not reached its minimum 48 hours before the start, it is called off automatically and everyone who booked gets the full price back in credit.
- Instructors run their own workshops and studios run their own spaces; each is responsible for what they offer. GroovaClass provides the platform that connects them with you.
5. Cancelling and refunds
The details are in the Cancellation & Refund Policy. In short:
- You cancel 48 hours or more before the start: the full price goes back to your credit straight away.
- Less than 48 hours before the start: you can request a cancellation, and our team reviews it.
- The instructor, the studio or GroovaClass cancels: everyone who booked gets the full price back in credit, automatically.
- Refunds of a booking go to your credit. Credit goes back to a card when you close your account (section 10) or after a year without activity (section 3).
6. Instructors: earnings and payouts
- Workshops: GroovaClass keeps 10% of what learners pay for a workshop. The studio's flat fee is paid from the other 90%, and you receive the rest. For example, 10 learners at $20 is $200: GroovaClass keeps $20, the studio's $60 fee comes from the remaining $180, and you receive $120.
- Tutorial clips: you receive 90% of the price and GroovaClass keeps 10%.
- Your earnings page shows each amount. Earnings are held for a settlement window after the workshop (currently 48 hours) and then paid to your Stripe account through Stripe Connect. You need a connected Stripe account in good standing; until you have one, your payout waits.
- An instructor cannot cancel a workshop that has reached its minimum without our approval.
- You are responsible for the taxes on your earnings. Stripe may ask you for tax details.
- We may change these shares with 30 days' written notice to the instructors affected.
7. Studios
- You set your own hourly price for each space. The flat fee for a workshop is that price times the length of the time slot.
- The fee is earned when the workshop takes place and is paid through Stripe Connect after the settlement window. If the workshop is called off before it takes place, no fee is earned.
- You can cancel a booking more than 48 hours before the start; within 48 hours, ask us. Everyone who booked is refunded in full.
- Describe your spaces accurately, keep them safe and available at the times you open, and follow the rules that apply to your premises, including insurance.
8. Content
- Ownership: instructors keep ownership of the Classes, videos and tutorial clips they publish. GroovaClass does not claim ownership of what members publish.
- Licence: by publishing, you give GroovaClass a non-exclusive, royalty-free licence to display, stream, reproduce and promote that content on and through the platform.
- Your rights: publish only what you have the rights to, including the music. We may remove content that infringes someone's rights or breaks these Terms.
- Class videos play from YouTube and are subject to YouTube's terms.
- Removal: write to support to have your content removed; it can take up to 7 business days to disappear everywhere.
9. Conduct and security
You agree not to:
- access accounts, data or systems that are not yours, or exploit a bug or security flaw, whether you found it by accident or on purpose;
- send requests or change data in ways the site does not offer, such as raising a balance, editing payments or bookings, or giving yourself more access;
- use bots, scripts or scrapers on the platform without our written permission, or intercept its traffic;
- decompile or reverse-engineer the platform, or get around its security;
- open several accounts to collect promotional credit or avoid a suspension, or sell invitation codes;
- file chargebacks for workshops that took place, or manipulate reviews, ratings or booking counts;
- impersonate anyone, or harass, threaten or harm other members.
If you do
We may suspend or close your account at once. Credit you were given is forfeited, and earnings and payouts may be held while we look into it. To the extent the law allows, we may use your remaining purchased credit or earnings to cover losses the conduct caused, and we may seek other legal remedies. You agree to cover GroovaClass's losses and costs, including reasonable legal fees, that your prohibited conduct causes.
Reporting a security problem
If you find a vulnerability, report it to support@groovaclass.com instead of using it. If you report in good faith, without causing harm or looking at other members' data, we will not close your account for it.
10. Suspension and closing your account
- We may suspend or close an account that breaks these Terms, commits fraud or harms the community. While an account is suspended it cannot use the platform; a suspended instructor's upcoming workshops are cancelled and everyone who booked is refunded in full; the account's content is hidden.
- You can close your account from your profile. Bookings more than 48 hours away are cancelled and refunded; bookings closer than that stay. The unspent credit you bought then goes back to the cards you bought it with, most recent purchase first; Stripe's fee is not returned, and credit you were given is not paid out. The account is kept for 30 days in case you change your mind, then deleted.
11. Health, safety and liability
- Dance fitness is physical activity. Take part only if you are fit to, follow the instructor's guidance, and stop if you feel pain or unwell. If you have a health condition, are pregnant or are unsure, check with a doctor first. You take part at your own risk.
- GroovaClass is provided "as is", without warranties of any kind. We do not guarantee that it will always be available or free of errors.
- To the extent the law allows, GroovaClass is not responsible for the quality or safety of workshops, choreography or studios, for interactions between members, or for injuries, accidents or damage during workshops or at studios.
- To the extent the law allows, GroovaClass's total liability to you is limited to the value of your credit balance at the time of the claim.
- Nothing in these Terms limits rights that the law does not allow to be limited.
12. Changes to these Terms
We may update these Terms. When we do, we change the date at the top of this page and, for important changes, tell you on the site or by email. If you keep using GroovaClass after a change, you accept the new Terms; if you don't agree, you can close your account (section 10).
13. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules.
- First, talk to us: write to support@groovaclass.com and give us at least 30 days to resolve it in good faith.
- Then, arbitration: a dispute that is not resolved that way is settled by binding arbitration in Boston, Massachusetts, under the applicable arbitration rules.
- Disputes are resolved individually; you waive the right to take part in a class action.
